Terms of Use

PROOFOFLOVE.EARTH is a public, community-created archive of geographically placed messages and moments intended to reflect love, kindness, connection, and humanity.

Users may submit messages associated with locations on a public map.

Submissions are subject to moderation and are not guaranteed to be reviewed, approved, or published.

The Service, its features, appearance, functionality, availability, moderation practices, and technical systems may be modified, restricted, suspended, or discontinued at any time.

You must be at least 13 years old to submit content or otherwise provide personal information through the Service.

The Service is not intended for children under 13.

You retain ownership of original content you submit.

You are responsible for the content you submit and for ensuring that you have the legal right to submit it.

By submitting content, you represent and warrant that:

• You created the content or otherwise possess all rights, licenses, permissions, consents, and authorizations necessary to submit it;
• You have the right to grant the license described in these Terms;
• Your submission does not infringe or misappropriate another person’s copyright, trademark, privacy, publicity, or other rights;
• Your submission does not unlawfully disclose another person’s private or sensitive information;
• Your submission does not violate applicable law; and
• Your submission complies with these Terms and the Community Guidelines.

Do not submit content you do not have the right to share.

You retain ownership of original content you submit.

By submitting content to PROOFOFLOVE.EARTH, you grant the operator of PROOFOFLOVE.EARTH a non-exclusive, worldwide, royalty-free license to host, store, reproduce, publish, publicly display, distribute, format, translate, and otherwise use your submission as reasonably necessary to operate, provide, moderate, maintain, improve, and promote PROOFOFLOVE.EARTH.

This license includes the ability to display or share your submission through PROOFOFLOVE.EARTH, PROOFOFLOVE.EARTH social media accounts, promotional materials, and other media or distribution methods related to the project.

This license does not transfer ownership of your original content to PROOFOFLOVE.EARTH.

You understand that you will not receive payment, royalties, or other compensation for your submission or for uses of the submission permitted by these Terms.

Submitting content does not guarantee review, approval, publication, or continued publication.

PROOFOFLOVE.EARTH is independently operated and has limited moderation capacity.

Although we may attempt to review submissions, we do not guarantee that:

• Any particular submission will be reviewed;
• Submissions will be reviewed in the order received;
• A submission will be reviewed within any particular period of time;
• A submission will be approved;
• An approved submission will be published immediately;
• Every eligible submission will be published; or
• A published submission will remain available permanently.

Submissions may remain pending for an indefinite period.

Submissions may also be rejected or deleted without review because of submission volume, limited moderation capacity, technical or storage limitations, suspected violations of these Terms or the Community Guidelines, safety or legal concerns, spam or abuse prevention, operational considerations, or other reasonable reasons.

The failure to review, approve, or publish a submission does not necessarily mean that the submission violated these Terms or the Community Guidelines.

PROOFOFLOVE.EARTH has no obligation to review every submission received.

PROOFOFLOVE.EARTH allows submissions to be associated with locations on a public map.

Locations may be precise and publicly visible.

By submitting a location, you acknowledge and understand that an approved submission may publicly display the precise location you selected.

Do not publish another person’s private residence, current whereabouts, sensitive location, or other private location information without permission where doing so could invade privacy, facilitate harassment, create a safety risk, or violate applicable law.

You are responsible for selecting a location you are comfortable sharing publicly.

Submissions may be manually reviewed before publication.

PROOFOFLOVE.EARTH may approve, reject, restrict, or remove content in its discretion based on:

• These Terms;
• The Community Guidelines;
• Safety concerns;
• Privacy concerns;
• Legal obligations;
• Intellectual-property concerns;
• Complaints;
• Submission volume;
• Available moderation capacity;
• Technical or operational considerations;
• The purpose of PROOFOFLOVE.EARTH; or
• Other reasonable considerations.

We may remove content at any time, with or without prior notice, including after it has previously been approved or published.

Publication does not create a right to continued publication.

We do not guarantee that every inappropriate, inaccurate, unlawful, infringing, harmful, or otherwise objectionable submission will be identified or removed immediately.

You may not use PROOFOFLOVE.EARTH to submit, publish, facilitate, or engage in:

• Threats or encouragement of violence;
• Harassment, stalking, intimidation, or bullying;
• Hate speech or targeted abuse;
• Doxxing or disclosure of private or sensitive personal information;
• Sexual exploitation;
• Sexual content involving minors;
• Encouragement or facilitation of self-harm;
• Fraud, scams, spam, or malicious activity;
• Deceptive or harmful impersonation;
• Copyrighted material you do not have permission or another legal right to use;
• Content violating another person’s trademark, privacy, publicity, or other legal rights;
• Defamatory or unlawfully false statements about another person;
• Illegal activity;
• Malware or malicious code;
• Attempts to compromise or interfere with the Service;
• Attempts to bypass moderation, authentication, rate limits, access controls, or security protections;
• Automated activity that unreasonably burdens or interferes with the Service;
• Scraping or automated collection intended to harvest personal, identifying, or location information about users or people mentioned in submissions; or
• Attempts to use PROOFOFLOVE.EARTH to facilitate harm to another person.

PROOFOFLOVE.EARTH may also remove or restrict content or conduct that we reasonably determine is harmful, invasive, deceptive, unlawful, inconsistent with the purpose of the Service, or creates unreasonable risk for another person, the public, or PROOFOFLOVE.EARTH.

Respect intellectual-property rights.

Do not submit song lyrics, poems, articles, photographs, book passages, artwork, scripts, or other copyrighted material unless you created the material, the material is in the public domain, or you otherwise have permission or a legal right to use it.

If you believe content available through PROOFOFLOVE.EARTH infringes your copyright or other intellectual-property rights, contact:

Please provide enough information to identify the work or rights at issue, the allegedly infringing material, your contact information, and the basis for your claim.

We may remove or disable access to material in response to copyright or intellectual-property complaints where appropriate.

Where appropriate, we may restrict submissions or access associated with repeated copyright infringement.

Additional copyright or DMCA procedures may be established separately.

You are responsible for considering the privacy, safety, dignity, and legal rights of people you identify, describe, or discuss in a submission.

PROOFOFLOVE.EARTH may remove a submission in response to a legitimate privacy, safety, intellectual-property, reputational, or other rights-related concern from a person identified in or affected by the submission.

Approval or publication of a submission does not mean that PROOFOFLOVE.EARTH has verified the identity of anyone mentioned in it or obtained consent from anyone mentioned in it.

PROOFOFLOVE.EARTH contains content created by users.

User submissions are the responsibility of the people who submit them and do not necessarily represent the views, opinions, beliefs, or statements of PROOFOFLOVE.EARTH.

You may encounter content that you consider inaccurate, upsetting, offensive, inappropriate, misleading, or otherwise objectionable.

Although submissions may be manually moderated, approval or publication does not constitute endorsement, verification, certification, or a guarantee that a submission is accurate, truthful, lawful, appropriate, or reliable.

PROOFOFLOVE.EARTH does not independently verify every factual statement contained in user submissions.

Any reliance on user-generated content is at your own risk.

The Service may provide automated translation using artificial intelligence or other machine-translation technology.

Translations may contain errors, omissions, or changes in meaning.

PROOFOFLOVE.EARTH does not guarantee the accuracy, completeness, or reliability of automated translations.

You are responsible for keeping your own copy of anything you submit.

PROOFOFLOVE.EARTH has no obligation to store, preserve, archive, recover, or provide you with a copy of any submission.

Submissions or other information may be deleted, lost, corrupted, unavailable, or removed.

Do not use PROOFOFLOVE.EARTH as the sole permanent storage location for important information.

The Service relies on third-party providers for functions such as hosting, databases, maps, fonts, geographic services, and automated translation.

Third-party services may be governed by their own terms and privacy practices.

PROOFOFLOVE.EARTH is not responsible for third-party services, websites, outages, policies, content, or conduct outside its reasonable control.

PROOFOFLOVE.EARTH is a community platform.

It is not a medical, psychological, counseling, crisis-intervention, emergency, legal, financial, or other professional service.

The Service and user submissions should not be relied upon as a substitute for professional services or emergency assistance.

User submissions do not constitute professional advice.

You may use the Service only in compliance with these Terms and applicable law.

You may not attempt to:

• Access non-public portions of the Service without authorization;
• Access another person’s information without authorization;
• Probe, scan, or test systems for vulnerabilities without authorization;
• Circumvent authentication or security measures;
• Interfere with or disrupt the Service;
• Introduce viruses, malware, or malicious code;
• Flood, overload, spam, or otherwise place an unreasonable burden on the Service;
• Manipulate likes, submissions, or other functionality through unauthorized automation; or
• Use the Service in a manner designed to compromise the privacy, safety, security, or rights of another person.

We may take reasonable technical or administrative measures to prevent abuse.

We do not guarantee that:

• The Service will always be available;
• The Service will be uninterrupted or error-free;
• Any submission will remain online permanently;
• Any submission will ever be reviewed;
• Data will never be lost;
• Maps, place labels, translations, or locations will always be accurate;
• Security incidents will never occur; or
• Third-party services will remain available.

The Service and any feature may be changed, limited, suspended, or discontinued.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, ARE DISCLAIMED.

PROOFOFLOVE.EARTH DOES NOT WARRANT THE ACCURACY, COMPLETENESS, AVAILABILITY, SECURITY, RELIABILITY, OR SUITABILITY OF THE SERVICE OR USER-GENERATED CONTENT.

Nothing in these Terms excludes rights or warranties that cannot legally be excluded.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE OPERATOR OF PROOFOFLOVE.EARTH AND ITS CONTRACTORS AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO:

• ACCESS TO OR USE OF THE SERVICE;
• INABILITY TO ACCESS OR USE THE SERVICE;
• USER-GENERATED CONTENT;
• CONDUCT OF USERS OR THIRD PARTIES;
• LOSS, DELETION, OR FAILURE TO STORE CONTENT;
• ERRORS OR INACCURACIES IN MAPS OR TRANSLATIONS;
• UNAUTHORIZED ACCESS TO OR ALTERATION OF INFORMATION; OR
• THIRD-PARTY SERVICES.

Liability is limited only to the extent permitted by applicable law.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless the operator of PROOFOFLOVE.EARTH and its contractors and agents from claims, liabilities, damages, losses, judgments, and reasonable expenses, including reasonable attorneys’ fees where recoverable, arising from or relating to:

• Content you submit;
• Your unlawful use of the Service;
• Your violation of these Terms or the Community Guidelines;
• Your violation of applicable law; or
• Your violation of another person’s intellectual-property, privacy, publicity, or other rights.

Your use of PROOFOFLOVE.EARTH or submission of content does not create an employment, partnership, joint venture, agency, fiduciary, franchise, or other special legal relationship between you and PROOFOFLOVE.EARTH or its operator.

We may restrict access, remove submissions, block abusive activity, impose technical limits, or take other reasonable measures when we believe these Terms or the Community Guidelines have been violated or when reasonably necessary to protect the Service, its users, the public, or others.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable law requires otherwise.

These Terms may be updated as PROOFOFLOVE.EARTH evolves.

The effective date above identifies the current version.

Additional notice of material changes may be provided where appropriate or required by law.

Your continued use of the Service after updated Terms become effective may constitute acceptance of the updated Terms to the extent permitted by applicable law.

If any provision of these Terms is found invalid or unenforceable, that provision will be limited or modified to the minimum extent necessary where permitted, and the remaining provisions will remain in effect.

Failure to enforce any provision of these Terms does not waive the right to enforce that provision or any other provision in the future.

These Terms, together with the Privacy Policy and Community Guidelines, constitute the applicable agreement governing use of PROOFOFLOVE.EARTH.
